These terms govern your use of this website and app and any order you place through them. By using this site or placing an order, you agree to these terms. If you don't agree, please don't use the site — you're always welcome to order in person or by phone instead.

Who we are

Kumbha-Yah ("we," "us," "our") operates a cafe, convenience store, and fuel station at 4986 Gender Road, Canal Winchester, OH 43110. You can reach us at ops@kumbhayah.com or 614-829-2060.

Online ordering

This site is for pickup orders only — we don't offer delivery through this website or app. When you place an order, you're asking us to prepare it for pickup at the location and time you select. Placing an order doesn't guarantee a specific pickup time; we do our best to have your order ready when requested, but preparation times can vary with how busy the kitchen is.

Age-restricted products (tobacco, and any other items that legally require ID verification) aren't available through online ordering — those can only be purchased in person, where we can check ID at the time of sale.

Prices, availability & menu changes

Prices, items, and availability shown on this site come directly from our point-of-sale system and can change without notice — including after you've viewed a page, but before you check out. If an item you ordered turns out to be unavailable, we'll contact you using the phone number or email you provided to sort out a substitution, refund, or adjustment.

Payment

Payment is processed entirely by Clover, our third-party payment processor — you enter your card details directly on Clover's own secure checkout page. We never see or store your full card number. By placing an order, you authorize us to charge the payment method you provide for the full order total, including applicable tax.

Cancellations & refunds

Because most orders go into preparation quickly, we can't guarantee a cancellation once it's been submitted — call us as soon as possible at 614-829-2060 if you need to cancel or change an order, and we'll do what we can. If we're unable to fulfill your order for any reason on our end (an item is out of stock, the store is unexpectedly closed, etc.), we'll issue a full refund for the affected items.

If there's a genuine problem with your order — something missing, made incorrectly, or a quality issue — let us know when you pick up or shortly after, and we'll make it right.

Food & product disclaimers

Our kitchen handles common allergens (wheat, dairy, eggs, soy, tree nuts, and others) — while we're happy to answer questions about ingredients, we can't guarantee any item is completely free of cross-contact with allergens. If you have a food allergy or sensitivity, please ask a team member before ordering, and use your own judgment about what's safe for you to eat.

Loyalty programs

Yah! Rewards (run on RewardUp) and Shell Fuel Rewards are operated by third parties on their own websites, with their own separate terms. Joining and using either program is governed by that program's terms, not these ones.

Acceptable use

Please use this site for its intended purpose — browsing our menu and placing genuine orders for yourself. Don't attempt to disrupt the site, submit false or abusive orders, scrape or copy the site's content for other uses, or otherwise misuse it. We may refuse service or cancel orders we reasonably believe are fraudulent, abusive, or made in bad faith.

Intellectual property

The Kumbha-Yah name, logo, and the content on this site (text, photos, and design) belong to us and may not be copied or reused without our permission, except for the ordinary use of browsing and ordering from the site.

Limitation of liability

We provide this site "as is." To the fullest extent permitted by law, we aren't liable for indirect, incidental, or consequential damages arising from your use of the site or an order placed through it, beyond the amount you actually paid for that order. Nothing here limits liability that can't legally be limited (for example, liability for gross negligence or willful misconduct).

Governing law

These terms are governed by the laws of the State of Ohio, without regard to conflict-of-law principles.

Changes to these terms

We may update these terms from time to time. If we make material changes, we'll update the effective date above. Your continued use of the site after a change means you accept the updated terms.
